New equipment, machinery, or parts furnished to standard specifications or to specifications approved or ordered by the purchaser are warranted as follows:
- Resale machinery, merchandise, or parts: according to the terms of the manufacturers original warranty.
- Products of Russell Truck Ltd., warranted to be free from defects for a 90 day period from the date of shipment: The obligation under this warranty is limited for to replacement or repair, at our factory, of such defective merchandise, when it is returned freight prepaid and found to our satisfaction to be defective in material or workmanship.
This warranty does not obligate this company to bear the cost of transportation or labour charges in connection with the replacement or repair of defective machinery or parts. Nor shall it apply to a machine upon which repairs or alterations have been made, unless authorized by this company.
We shall in no event be liable for consequential damage or contingent liabilities or losses arising out of failure of any machine or part to operate satisfactorily, nor shall we be liable for any commitment, promise or obligation implied or stated by any resale dealer, wholesaler, jobber, and etc.
Unless an officer of this company gives prior authorization, we will not be responsible for cost incurred in repairing, altering, or modifying any machinery or equipment, either in the replacement or parts or otherwise claimed defective, inferior, inadequate, wrongly designed, or applied, and any such expense or cost incurred will be the sole responsibility of the purchaser.
